1. Acceptance of Terms

By accessing or using Capperly (the “Service”), including our website and mobile apps, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 21 years old and located in a jurisdiction where use of a sports betting companion tool is lawful. You are solely responsible for ensuring your use of the Service complies with all applicable local, state, and federal laws.

3. Accounts

Accounts are created through third-party authentication (Google or Apple). You are responsible for maintaining the security of your account and for all activity under it. You may delete your account at any time from Settings within the app.

4. Acceptable Use

You agree not to misuse the Service, including attempting to disrupt or interfere with it, scraping or harvesting data at scale, circumventing security or access controls, reselling or redistributing content without permission, impersonating others, or uploading unlawful, infringing, or abusive content.

5. Betting Disclaimer

Capperly is an informational and bet-tracking tool. It is not a sportsbook, does not accept or place wagers, and does not guarantee any outcome. Picks, statistics, and capper records are for informational purposes only and are not financial or betting advice. All betting decisions are your own, and you bet at your own risk. 6. Subscriptions & Payments

Some features are offered through paid subscriptions. Payments are processed by Lemon Squeezy, which acts as the Merchant of Record and seller for these transactions; your purchase is also subject to Lemon Squeezy’s terms. Where you subscribe through the Apple App Store or Google Play, that store’s payment terms and policies apply. Fees are disclosed before purchase. Subscriptions renew automatically until cancelled, and you can cancel at any time; cancellation stops future renewals and access continues until the end of the current paid period.

7. Refunds

Except where required by law or by the applicable app store’s policies, subscription fees are non-refundable. Purchases made through the Apple App Store or Google Play are subject to that store’s refund process. For payments processed by Lemon Squeezy, refund requests are handled in accordance with Lemon Squeezy’s policies; contact us and we will assist where we can.

8. Third-Party Cappers & Content

The Service may surface picks, records, and content from independent third-party cappers and other users. Capperly does not create, endorse, or guarantee this content and is not responsible for its accuracy or for any losses arising from reliance on it. Any dealings between you and a third party are solely between you and that party.

9. Intellectual Property

The Service, including its design, logos, and software, is owned by Capperly and protected by applicable laws. User-generated content remains yours, but you grant Capperly a non-exclusive, worldwide, royalty-free license to host, display, and use it as needed to operate and provide the Service.

10. Termination

We may suspend or terminate access for violations of these Terms or for conduct that harms the Service or other users. You may stop using the Service and delete your account at any time.

11. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, Capperly is not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any lost profits or betting losses, arising from or related to your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Capperly operates, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, communicated in the app. Continued use after changes constitutes acceptance of the revised Terms.
